1. Acceptance of Terms
By accessing or using OsintCat ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and OsintCat.
2. Description of Service
OsintCat is an open-source intelligence (OSINT) platform that provides access to publicly available information and data sources through a web-based dashboard and RESTful API. Our Service includes, but is not limited to:
- Email, phone, username, and domain intelligence lookups
- Social media platform data aggregation (Discord, Reddit, GitHub, Twitter, etc.)
- Gaming platform intelligence (Roblox, Minecraft)
- Data breach and stealer log searches
- IP address and DNS resolution services
- API access for programmatic queries
3. Eligibility and Account Registration
To use our Service, you must:
- Be at least 18 years of age or have parental consent
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your account credentials and API keys
- Accept responsibility for all activities that occur under your account
You are prohibited from creating multiple accounts to circumvent usage limits or restrictions.
4. Acceptable Use Policy
4.1 Permitted Uses
Our Service is designed exclusively for legitimate and ethical purposes, including:
- Cybersecurity research and threat intelligence
- Fraud prevention and investigation
- Digital forensics and incident response
- Security assessments and penetration testing (with proper authorization)
- Academic research and educational purposes
- Personal data verification (your own data only)
4.2 Prohibited Uses
You agree NOT to use the Service for any of the following activities:
- Illegal Activities: Any use that violates applicable local, state, national, or international laws or regulations
- Harassment or Stalking: Using the Service to harass, stalk, threaten, intimidate, or defame individuals
- Unauthorized Access: Attempting to gain unauthorized access to accounts, systems, or networks
- Identity Theft: Using information obtained through the Service for identity theft or fraud
- Spam and Phishing: Generating spam, phishing emails, or malicious communications
- Data Scraping: Automated scraping, crawling, or systematic data extraction without explicit written permission
- Third-Party Data Lookups: Looking up data belonging to other individuals without their explicit consent or legal authorization
- Resale or Redistribution: Reselling, redistributing, or commercializing data obtained through the Service without authorization
- Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any part of the Service
5. Account Security and Credentials
5.1 Account Ownership and Sharing Prohibition
STRICTLY PROHIBITED: Each account is personal, non-transferable, and may not be shared, sold, leased, transferred, or made accessible to any third party under any circumstances. Account sharing, including but not limited to:
- Sharing login credentials (username, password, email) with others
- Allowing others to access your account through any means
- Selling, renting, or transferring account ownership
- Creating accounts on behalf of others or using accounts created by others
- Using shared or group accounts
Violation of this policy will result in immediate and permanent account suspension without refund, permanent ban, and may result in legal action for damages.
5.2 API Key and License Key Security
STRICTLY PROHIBITED: API keys and license keys are confidential credentials that must be kept secure and private. You agree to:
- NOT share, publish, expose, or distribute your API keys or license keys to any third party
- NOT embed API keys in client-side code, public repositories, public websites, or insecure storage
- NOT create proxy services, wrappers, or intermediaries that expose API access to others
- NOT provide API keys to others, even temporarily or for testing purposes
- NOT use API keys belonging to other users
- Immediately notify us if you suspect your API key or license key has been compromised
- Use API keys only for your own account and applications
Violation of API key or license key security policies will result in immediate account suspension without refund, permanent ban, and may result in legal action for damages.
We actively monitor for account and key sharing violations through IP address analysis, usage patterns, and other security measures. Any detected violation will be met with immediate enforcement action.
5.3 IP Whitelisting
For enhanced security, certain plans support IP address whitelisting. You are responsible for maintaining accurate whitelist configurations. We monitor IP addresses for security purposes and to prevent account sharing.
6. Subscription Plans and Payment Terms
6.1 Available Plans
We offer multiple subscription tiers with varying features and usage limits. Plan details, pricing, and features are subject to change with notice. Current plans include Free, Starter, Researcher, Investigator, and Enterprise tiers.
6.2 Payment Processing
Payments are processed through secure third-party payment processors (Stripe, PayPal, Plisio). We do not store complete payment card information on our servers.
6.3 Refund Policy
All sales are final. Refunds are not provided except as required by applicable law. We offer a free tier that allows you to test the Service before making a purchase. By purchasing a paid plan, you acknowledge that you have tested the Service and agree to the no-refund policy.
6.4 Plan Changes and Upgrades
You may upgrade your plan at any time. Upgrade pricing is calculated based on the difference between your current plan and the target plan. Downgrades may be subject to restrictions and will take effect at the next billing cycle.
7. Rate Limiting and Usage Restrictions
To ensure fair usage and system stability, we implement rate limiting on all API endpoints and web-based queries. Rate limits vary by subscription plan and may be customized for enterprise customers. Excessive requests may result in temporary throttling or account review.
Attempting to circumvent rate limits through automated means, multiple accounts, or other methods is prohibited and may result in account termination.
8. Data Processing and Privacy
By using our Service, you consent to the processing of your search queries and usage data as necessary to provide the Service. 9. Intellectual Property Rights
9.1 Our Intellectual Property
All content, software, code, designs, trademarks, logos, and materials on the Service are the exclusive property of OsintCat or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our express written permission.
9.2 Third-Party Data
The data provided through our Service is aggregated from publicly available sources and third-party databases. We do not claim ownership of this data. You are responsible for ensuring your use of such data complies with applicable laws and the terms of service of the original data sources.
9.4 API Usage
API access is granted under a limited, non-exclusive, non-transferable license for your internal use only. You may not use the API to create competing services or to resell access to our Service.
10. Service Availability and Modifications
We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We reserve the right to:
- Modify, suspend, or discontinue any part of the Service with or without notice
- Perform scheduled maintenance that may temporarily interrupt service
- Update features, endpoints, or data sources
- Change pricing, plans, or usage limits with reasonable notice
11. Data Accuracy and Disclaimers
The information provided through our Service is aggregated from publicly available sources and third-party databases. We make no warranties or representations regarding:
- The accuracy, completeness, or timeliness of the data
- The availability or reliability of data sources
- The suitability of the data for any particular purpose
You acknowledge that data may be outdated, incomplete, or inaccurate. Use the information at your own risk and verify critical information through independent sources.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSINTCAT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any errors or omissions in the data provided
- Unauthorized access to or alteration of your data
- Third-party conduct or content on the Service
- Service interruptions or technical failures
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless OsintCat, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including privacy or intellectual property rights
- Any data or content you submit, post, or transmit through the Service
14. Account Termination and Suspension
14.1 Termination by You
You may terminate your account at any time by contacting us or using account deletion features (where available). Upon termination, your access to the Service will cease immediately.
14.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice or refund, permanent ban, and may result in legal action for damages, if:
- You violate these Terms or our Acceptable Use Policy
- You engage in illegal activities or use the Service for malicious purposes
- You share, sell, transfer, or allow access to your account, API keys, or license keys (ZERO TOLERANCE POLICY)
- You create multiple accounts to circumvent usage limits or restrictions
- You attempt to circumvent rate limits or usage restrictions
- You engage in abusive, harassing, or disrespectful behavior toward our staff or other users
- You fail to pay required fees
- We detect account sharing, key sharing, or unauthorized access through our monitoring systems
- We determine, in our sole discretion, that your use poses a risk to the Service or other users
Account sharing and key sharing violations result in permanent bans with no possibility of appeal or refund, and may result in legal action for damages.
14.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, and limitations of liability.
15. Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
15.2 Dispute Resolution Process
In the event of any dispute arising from or relating to these Terms or the Service, you agree to first contact us to seek an informal resolution. If informal resolution is not possible, disputes shall be resolved through binding arbitration in accordance with German arbitration law, or through the competent courts of Hamburg, Germany.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email (to the address associated with your account) or through a prominent notice on our platform. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
If you do not agree to the modified Terms, you must discontinue use of the Service and may terminate your account.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and OsintCat regarding the Service and supersede all prior agreements and understandings.
